How Licensing of Real Estate Photography Works

Copyright and Licensing: What You Need to Know

Under the U.S. Copyright Law, creative products like music and photographs are protected as soon as they are created in a tangible form. It is crucial to be aware of the law, given the range of data provided on the internet. It might be difficult to grasp copyright law, but you must have knowledge of it, especially with all the data available. If you are arranging an ad or listing campaign with a photographer, you must first know about copyright and licensing standards in photography. Read on to learn how licensing of real estate photography works.

The Photos Are the Intellectual Property of the Photographer

You can’t use the photos without the photographer’s permission, so paying for a photographer’s services doesn’t give you ownership of the photos. You also can’t use the photos as you wish without the photographer’s consent.

What Are Your Rights

After you purchase my real estate photography services, you will receive an invoice that details my terms and conditions. In a nutshell, after paying for the products, you have my permission to use them for advertising, such as posting photos on social media or placing them in magazines. You may also use them for commercial purposes after you sign a contract with my company. Commercial photography refers to photos used for advertising, whether they’re used by large organizations or individuals. The rights to the photos can be more extensive, as you’ll have to pay a higher fee if you want them for business purposes.

Agreements with the Photographer

Anything outside of your rights to do with the photographer’s photos should be sought first. For example, you cannot give the images to someone else or another agent, nor can you distribute, display, or sell them without the photographer’s agreement. You may also not transfer your temporary permission to use the photographs to other people.

The License to Use the Images

Photographers grant usage licences to the photos in return for a payment. That temporary licence is essentially a legal document that a photographer gives you after completing the payment plan. After agreeing on the payment, you obtain a licence granting you use of the pictures. The pictures may be used for commercial purposes for a limited time period and then removed from the market. When an agent wants to use a photographer’s merchandise again after the listing has expired, they must discuss the relicensing terms, including a licensing charge.

Cost of a License

There is no definite amount for a license as it depends on the number of images, their value, distribution, or the possible return on investment. A real estate license has a lower cost than in commercial photography in the industry. It is because the images do not sell a brand and they have limited use.

Commercial Photography Pricing

In commercial photography, pricing depends on the quality of work a project requires. For instance, vacation rental images may not be as expensive to produce as restaurant photos. However, buying the full rights to pictures – if you want to – maybe costly all the same, like triple the price of a temporary license, but you can do anything with the photos as the new copyright holder.
